Water Service Standby Assessment on Vacant Parcels of Land within City
Elam, City Manager
of a resolution establishing the annual water service standby charges
on vacant parcels of land within the City limits for Fiscal Year 2000/01,
assessing the charge, and declaring that the charge be collected as part
of the annual general County tax bill.
August 24, 1999, the City Council adopted Resolution No. 99-194 establishing
the annual water service standby charge for fiscal year 1999-00.
Fiscal Year 1990/91, the City Council established the annual water service
standby charge at sixty dollars ($60.00), or five dollars ($5.00) per
month per vacant parcel of land, irrespective of the size of the parcel.
The charge applies to land that was vacant as of January 1 the
year under consideration. The
charge was assessed to each vacant parcel within the City limits, and
collected as part of the annual general county tax bill.
Subsequent annual water service standby charges have similarly
been set at the same sixty dollars ($60.00) per parcel, irrespective of
size. These charges are levied
to fund capital costs or maintenance and operation expenses for the City’s
water facilities. Each year
since 1990, the Council has adopted a resolution assessing these charges.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE
CITY MANAGER TO RENEW THE ANNUAL WATER SERVICE STANDBY CHARGE FOR VACANT
PARCELS OF LAND WITHIN THE CITY LIMITS FOR FISCAL YEAR 2000/01 AS A PART
OF THE ANNUAL COUNTY TAX BILL
Section 38743 of the California Government Code allows the establishment
of an annual water service standby charge; and
in previous years the charge has been established at sixty dollars ($60.00)
per vacant parcel, and
City Council desires to establish the same charge for Fiscal Year 2000/01,
an updated list of vacant property within the City limits has been prepared
and is available at the Public Works office; and
WHEREAS, the City has studied
the current charge per parcel and has concluded that no change from the
previous year’s charge is warranted.
The charge does not exceed the reasonable cost of making available
water service and facilities to vacant properties, is proportionately
representative of the costs incurred by the City and the special benefit
conferred on each parcel, and is consistent with Government Code Section
the annual water service standby charges is imposed exclusively to finance
the capital costs or maintenance and operation expenses for the City’s
water facilities and is imposed at the same rate as in the previous year;
WHEREAS, this annual
water service standby charge is an existing assessment under Article XIII
D, Section 5(a) of the California Constitution and is therefore exempt
from the procedure and approval process set forth in Section 4 thereof.
NOW, THEREFORE BE IT RESOLVED
by the City Council of the City of Brentwood, that the annual water service
standby charge of sixty dollars ($60.00) per vacant parcel is hereby assessed
on those vacant parcels within the City limits.
