BACKGROUND

Article XIIIB of the California State Constitution, more commonly referred to as the Gann Initiative, was adopted by California voters in 1980 and placed limits on the amount of proceeds of taxes that state and local governmental agencies can appropriate each fiscal year.  The Appropriations Limitation does not apply to enterprise funds, redevelopment joint powers authorities or bond issues.

The Limit is based on actual appropriations during the 1986-87 fiscal year, and is increased each year using the growth of population and inflation.  In June, 1990 the voters approved Proposition 111 which provided new adjustment formulas which makes the Appropriations Limit more responsive to local growth issues.  The annual adjustment made to the Limit  is based on a formula which  include the following factors:

Change to City population                           or            Change in population for the entire County

                                      AND

Change in State per capita income              or            Change in nonresidential assessed valuation

Typically, an agency selects the factors which provide for the largest growth in the Limit.  For the calculation of the 2000-01 Limit, the Change in City population is used as it provides a greater Limit.

Article XIIIB specifies that local jurisdictions select their cost-of-living factor to compute their Appropriation Limit by vote of their governing body.  The cost of living factor provided here is per capita personal income at 4.91%.  If the percentage change in per capita personal income is selected, the percentage changes to be used in setting the 2000-01 Appropriation Limit are:

Appropriations Limit for Fiscal Year 1999/00                                                      $14,047,450

            Fiscal Year 1999/00

                       Population in January 1999                               20,235

                       Population in January 2000                               23,090

                                   Percentage Increase in Population-City                 14.11%

                       Percentage Increase in Population-County                      0.61%

California Per Capita Personal Income                    4.91%

Factor to be applied to Prior Year                          1.197128%

(Population Factor x Per Capita Factor)

Appropriations Limit for Fiscal Year 1999/00                                            $16,816,596

Appropriations Subject to Limitation                                                         $  8,315,576

                        Margin                                                                                         $  8,501,020

FISCAL IMPACT: There is no fiscal impact to any of the city funds as the Appropriations subject to limitation are less than the Appropriations Limit for the 2000/01 Fiscal Year.
