Subject/Title:     Authorize the City Manager to apply for A Department of Conservation-Division of Recycling Grant to fund various recycling-related projects.

RECOMMENDATION

Approve a resolution authorizing the City Manager to execute all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing Department of Conservation-Division of Recycling Funding and to implement and carry out the purposes specified in the Application.

BACKGROUND

The State of California has enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to cities and counties for establishing and maintaining beverage container recycling and litter reduction programs.  The California Department of Conservation’s Division of Recycling offers annual funding to local governments to implement programs.

The funding will be available annually.  It is based on population figures and the funding comes from the beverage container deposits paid by consumers at the point of sale.  The City of Brentwood is eligible for a minimum of $5,000, but based on our population has the potential to receive up to $5,861 this year.

In order to take advantage of this funding, we are required to file an application and a resolution by May 31, 2000.  The application and the resolution are attached and presented to the City Council for approval.  If approved, staff will submit the documents and follow through with an executed agreement with the State of California in order to secure these funds.  The plan is to use these funds to promote beverage container recycling and to provide additional recycling containers to those in need of more collection capacity.

The City of Brentwood would be eligible to receive $5,861 a year from this funding program.  These funds will help to defray costs of the recycling education and additional recycling containers.

RESOLUTION NO.

AUTHORIZE THE CITY MANAGER TO APPLY FOR A DEPARTMENT OF CONSERVATION-DIVISION OF RECYCLING GRANT TO FUND VARIOUS RECYCLING-RELATED PROJECTS.

WHEREAS, the people of the State of California have enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to cities and counties for beverage container recycling and litter cleanup activities; and

WHEREAS, the California Department of Conservation’s Division of Recycling has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program; and

WHEREAS, per Section 14581 (a)(4)(E) of the California Beverage Container Recycling Act, the eligible participant must submit the Funding Request Form by the due date and time in order in order to request funds from the Department of Conservation’s Division of Recycling.

NOW, THEREFORE BE IT RESOLVED that the City Council authorizes the submittal of the Funding Request Form to the Department of Conservation’s Division of Recycling.  The City Manager, or a designee, is hereby authorized and empowered to execute in the name of the City of Brentwood all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing funding and to implement and carry out the purposes specified in the Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and provide information regarding this program to the Division upon request.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 23rd day of May 2000 by the following vote.
