Subject/Title: Agreement for Purchase and Sale with Strickler Family Partnership (New Fire Station #52, CIP Project No. 336-3109)

RECOMMENDATION

Passage of a Resolution approving an agreement for purchase of a fee parcel, with Stickler Family Partnership, a general partnership, for a portion of real property identified as APN 019-340-038, accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the deed.

PREVIOUS ACTION

On November 20, 1997 the City Council approved CIFP 94-1 that provided financing for the majority of this facility and described and confirmed the need for it to protect the public safety.

On May 25, 1999, the City Council approved Resolution 99-134 finding there was no substantial evidence that the 1999-2004 Capital Improvement Program would have any significant adverse environmental impacts, and directed the City Clerk to file the Notice of Determination.

On April 11, 2000 the City Council authorized amending the 1999-2004 Capital Improvement Program to increase the budget for the proposed New Fire Station #52, CIP 336-3109, and adding the adjacent roadway improvements.

BACKGROUND

The construction of a new fire station is necessary to maintain adequate fire service and emergency health services to the rapidly expanding western area of Brentwood. The facility will also include a one-room police/community substation facility.

Funding for this project is through CIP Project No. 336-3109.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL, WITH STICKLER FAMILY PARTNERSHIP, A GENERAL PARTNERSHIP, FOR A PORTION OF REAL PROPERTY IDENTIFIED AS APN 019-340-038, ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, a portion of the real property identified as APN 019-340-038 in the City of Brentwood, that is owned by Strickler Family Partnership, a general partnership is needed for the New Fire Station Project, CIP 336-3109; and

WHEREAS, an Agreement for Purchase and Sale between the City of Brentwood and the Strickler Family Partnership, a general partnership has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Agreement for Purchase and Sale is approved.

BE IT FURTHER RESOLVED that the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the Agreement for Purchase and Sale and any related escrow documents including acceptance of the Grant Deed.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 9th day of May, 2000, by the following vote:
