RECOMMENDATION

Approve a resolution authorizing the closure of certain streets and temporarily establishing No Parking Restrictions and Tow Away Zones to facilitate Cornfest "2000" on July 7 - 9, 2000, and repealing Resolution No. 2002

PREVIOUS ACTION

City Council adopted Resolution No. 2002 on January 25, 2000 authorizing the closure of certain streets and temporarily establishing no parking restrictions and tow away zones to facilitate the Chamber of Commerce Cornfest "2000" to be held July 7-9, 2000.

BACKGROUND

Since the adoption of Resolution No. 2002 on January 25, 2000 the Chamber of Commerce has requested some minor modification to the street closure hours. Resolution No. 2002 should be repeals and the proposed resolution adopted to reflect the modifications requested by the Chamber of Commerce.

RESOLUTION NO

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CLOSURE OF CERTAIN STREETS AND TEMPORARILY ESTABLISHING NO PARKING RESTRICTIONS AND TOW AWAY ZONES IN ORDER TO FACILITATE THE CHAMBER OF COMMERCE CORNFEST "2000" TO BE HELD JULY 7, 8, AND 9, 2000, AND REPEALING RESOLUTION NO. 2002

WHEREAS, the Brentwood Chamber of Commerce will start preparation for the Cornfest on July 5 no earlier than 6:00 p.m., hold the Cornfest "2000" on July 7, 8 and 9, 2000 between hours not earlier than 3:00 p.m. and 10:00 p.m. on Friday, July 7th, between the hours of 10:00 a.m. and not later than 11:00 p.m. on Saturday, July 8th and 10:00 a.m. to 6:00 p.m. on Sunday, July 9, 2000 with clean-up to follow; and

WHEREAS, to accommodate the Chamber of Commerce Cornfest "2000", it is requested that the following streets be closed to traffic, no parking and tow away zones be established:

  • Maple Street, between Second Street and the end of Third Street, between 6:00 p.m. Wednesday, July 5, 2000 and l0:00 p.m. July 9, 2000.
  • Maple Street, between Midway Alley and Second Street, between 10:00 p.m. Thursday, July 6, 2000 and 10:00 p.m. Sunday, July 9, 2000.
  • Second Street, between Brentwood Blvd. and 30’ south of Oak Street, between the hours of 10:00 p.m. Thursday, July 6, 2000 and 10:00 p.m. Sunday, July 9, 2000.
  • Pine Street between Midway Alley and Second Street, between the hours of 10:00 p.m. Thursday, July 6, 2000 and 10:00 p.m. Sunday, July 9, 2000.
  • Oak Street, between Midway Alley and the mid-block of Third Street and Fourth Street, between the hours of 10:00 p.m. on Thursday, July 6 and 10:00 p.m. Sunday, July 9, 2000.
  • Oak Street, between the mid-block of Third Street and Fourth Street, to the east property line of the Liberty Union High School District property, on Friday July 7, 2000 ll:00pm and Saturday July 8, 2000 l1:00 p.m.

WHEREAS, pursuant to Vehicle Code Section 21101(e) the City may temporarily close portions of streets for parades and local special events such as Cornfest when the closing is necessary for the safety and protection of persons who are to use those portions of the streets during the temporary closure; pursuant to Vehicle Code Section 22507, the City may prohibit parking on portions of streets during all or certain hours of the day; pursuant to Vehicle Code Section 22651(b), (m) and (n), City peace officers may remove by towing any vehicle from those portions of the streets where parking is prohibited; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the Police Department is ordered to close the above mentioned streets, prohibit parking and establish a tow-away zone between the hours of 6:00 p.m. Wednesday July 5, 2000 and 10:00 p.m. Sunday July 9, 2000.

BE IT FURTHER RESOLVED that the closure of the streets is necessary for the safety and protection of persons enjoying the Cornfest activities and that the enforcement of the closure, no parking and tow-away zones shall not occur unless signs are posted within the affected areas at least 3 days in advance which advises the public of these rules and warns of immediate towing if violations occur.

PASSED AND ADOPTED by the City Council of the City of Brentwood, at its regular meeting of May 9, 2000, by the following votes:
