RECOMMENDATION

Passage of a Resolution approving the Final Map of Subdivision 8195-Ashton Place Unit 3 located in SPA ‘L’ on the westerly side of Minnesota Avenue north of Sand Creek, accepting the offers of dedication shown thereon subject to acceptance of improvements, and authorizing the Mayor and City Clerk to execute the same. 

PREVIOUS ACTION

On June 3, 1997, by Resolution No. 97-21, the Planning Commission approved Tentative Subdivision Map 8033, with conditions.  

On March 14, 2000, by Resolution No. 2031, City Council approved the Final Map of Subdivision 8195, accepting the offers of dedication shown thereon subject to the acceptance of improvements, accepting the improvement security, and approving the Subdivision Improvement Agreement. 

BACKGROUND

The Final Map dedications were accepted by Council on March 14, 2000, but the owner’s offer of dedication was unacceptable because the owner did not have interest in the land at that time. Now that Pulte Homes, the current owner, has an interest in the land the city can now accept the dedications. 

RESOLUTION NO. 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE FINAL MAP OF SUBDIVISION 8195-ASHTON PLACE UNIT 3, LOCATED IN SPA ‘L’ ON THE WESTERLY SIDE OF MINNESOTA AVENUE NORTH OF SAND CREEK, ACCEPTING THE OFFERS OF DEDICATION SHOWN THEREON SUBJECT TO ACCEPTANCE OF IMPROVEMENTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE SAME 

WHEREAS, on June 3, 1997, by Resolution No. 97-21, the Planning Commission of the City of Brentwood approved the Tentative Map of Subdivision 8033, with conditions; and 

WHEREAS, Final Map 8195 showing 42 single family residential lots has been prepared for this subdivision; and 

WHEREAS, City staff has checked the Final Map for conformance with the approved Tentative Map and the Conditions of Approval dated June 3, 1997, and finds that the Final Map is ready for approval. 

WHEREAS, on March 14, 2000, by Resolution No. 2031, City Council approved the final map of 8195, accepting the offers of dedication shown thereon subject to the acceptance of improvements, accepting the improvement security, and approving the subdivision improvement; and 

WHEREAS, The Final Map dedications were accepted by Council on March 14, 2000, but the owner’s offer of dedication was unacceptable because the owner (Pulte Homes) did not have interest in the land at that time; and 

WHEREAS, Pulte Homes, the current owner, now has an interest in the land and the City can now accept the dedications. 

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the Final Map for Subdivision 8195 – Ashton Place Unit 3, and that the offers of dedication shown thereon are hereby accepted subject to acceptance of improvements. 

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 25th day of April 2000 by the following vote:
