Subject/Title:     Approve First Amendment to Joint Exercise of Powers Agreement with Flood Control District for Marsh Creek Widening (CIP 562-5618)

RECOMMENDATION

Authorize the Mayor to execute the First Amendment to the Joint Exercise of Powers Agreement for Marsh Creek Widening (CIP Project No. 562-5618) and authorize an additional $48,200 for utility relocation and construction contingencies.

PREVIOUS ACTION

Approval of Resolution No. 96-194 on December 10, 1996 authorizing Joint Exercise of Powers Agreement (JEPA) with Contra Costa County Flood Control District (CCCFCD) for the Marsh Creek Widening Project.

Approval of Resolution 98-88 on May 26, 1998 authorizing the second JEPA with CCCFCD, apportioning financial responsibilities and use of sub-regional drainage fees for the Marsh Creek Widening Project.

BACKGROUND

This project has been a Council priority for several years.  The utility relocation costs and Department of Fish and Game approval have been the only outstanding issues.  Fish and Game approval was received for this project in early February 2000.  The City and CCCFCD have each agreed to pay 50% of the cost of relocating the joint trench utilities to move this project to construction scheduling with PG&E and Pacific Bell.

The County intends to bid this project beginning April 28, 2000 for construction this summer.  The original JEPA for the project included the closure of Dainty Avenue for approximately three months for construction of the bridge crossing of Marsh Creek.  Item No.          on this agenda is requesting Council action approving the closure of Dainty Avenue for 11 weeks for this project.
