RECOMMENDATION

Adopt a resolution approving a Notice of Completion on Homecoming Park by GoodLanD Landscape Construction, and Authorizing Release of Surety 

PREVIOUS ACTION

Council notified GoodLanD Landscape Construction to proceed with a 30 day maintenance period at Homecoming Park starting, December 1, 1999 

 BACKGROUND:

GoodLanD Landscape Construction has completed contract work on all phases of construction at Homecoming Park. When the contractor entered his maintenance period, the playground equipment had not been provided or installed.  The City issued a Change Order to the original playground equipment to ensure compliance with the newly adopted ADA standards. The contractor offered to sod this park instead of seeding the new turf if the City would accept a 30-day maintenance period on this park instead of the 90-day period cited in the contract. Staff accepted this proposal with a view to opening the park earlier. Further delays in the provision of playground equipment and wet weather during February and early March extended the final completion of the playground, including ADA compliant resilient surfacing for wheelchair access. 

 Because of the delays in finishing the playgrounds, the contractor extended his maintenance period. The contractor repaired various concrete surfaces identified in the punch list items.  All appurtenances, including tables, benches, drinking fountain, lights, playground equipment and basketball backboards have been installed as specified. All plant material is growing and in a healthy condition.  The irrigation system is fully functional. All items identified as deficient in the final walk through of the park have been repaired or remedied. 

RESOLUTION NO. 00-_____ 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING A NOTICE OF COMPLETION ON HOMECOMING PARK (CIP Number 522-5208), BY GoodLanD Landscape Construction, AND AUTHORIZING RELEASE OF SURETY.  

                WHEREAS, on April 27, 1999, the Council approved a contract with GoodLanD Landscape Construction, for construction of park facilities at the Homecoming Park site; and 

                WHEREAS, GoodLanD Landscape Construction has completed contract work on all phases of construction at Homecoming Park; and 

                WHEREAS, all appurtenances and facilities contracted for installation have been satisfactorily completed; and 

WHEREAS, GoodLanD Landscape Construction’s maintenance period ended on March 30, 2000; and 

WHEREAS,          all systems are in good working order, the plant material is vigorous, and all items the City has identified as deficient have been repaired or remedied. 

                NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, approve the Notice of Completion for Homecoming Park, 

                BE IT FURTHER RESOLVED that the City Council authorize release of GoodLanD Landscape Construction’s Surety Bond for the Homecoming project. 

PASSED by the City Council of the City of Brentwood at its regular meeting of ------------, by the following vote:

 NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT: 

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 27th day of April 1999 enter into an agreement with GoodLanD Landscape Construction for the construction of Homecoming Park, Project # 52210, CIP # 522-5208-90050. 

The work described in contract documents was to furnish all material, labor, and equipment necessary to complete said project. 

The surety on said agreement was held by First National Insurance Company of America, 120 Montgomery St., San Francisco, CA 94104. 

On the 11th day of April 2000, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.  

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
