 RECOMMENDATION

Accept the on site improvements for maintenance, accept the Maintenance Bond (amount of $348,162.00, 15% of original bonds), accept the Performance and Payment Bonds for Trail along the railroad tracks on the east boundary of this subdivision (amount of $69,423.00) and release the associated Subdivision Performance and Payment Bonds (amount of $2,321,080.00, bond # 3SM91524700) for Subdivision 8178, Lyon Groves, William Lyon Homes, Inc.

 PREVIOUS ACTION

On June 3, 1997 the Planning Commission of the City of Brentwood approved Tentative Map 8033. Conditions of approval for this map required the developer(s) to make certain Master Plan Facility improvements.

On August 25, 1998 the City Council passed Resolution No. 98-148 approving the Final map of Subdivision 8178, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.

 On November 24, 1998 the City Council passed Resolutions No.98-202, No.98-203, No. 98-204 Approving Reimbursement Agreements with Pulte Home Corporation and William Lyon Homes, Inc. for costs associated with Master Plan Facility Improvements.

 BACKGROUND

This subdivision is located on the easterly side of Minnesota Avenue north of Sand Creek.  The reimbursement agreements executed November 24, 1998 cover six of the subdivisions included under Tentative Map 8033.  The improvements which qualify as excess capacity are offsite and oversize roadway improvements along Minnesota Avenue, offsite soundwall along Venoble and Sanders property on future Sand Creek Road, developer’s share of Sand Creek Road/railroad improvements, Fairview Avenue at Lone Tree Way turn lane improvements, oversize water main improvements, oversize sewer main improvements and developer’s share of Wastewater Treatment Plant expansion.

 RESOLUTION NO.        

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION OF STREET RIGHTS OF WAY SHOWN THEREON, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE PERFORMANCE AND PAYMENT BONDS FOR TRAIL AND RELEASING THE ASSOCIATED PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 8178, LYON GROVES, WILLIAM LYON HOMES, INC.

 WHEREAS, On June 3, 1997 the Planning Commission of the City of Brentwood approved Tentative Map 8033 with conditions; and

WHEREAS, On August 25, 1998 the City Council passed Resolution No. 98-148 approving the Final Map of Subdivision 8178, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, On November 24, 1998 the City Council passed Resolutions No. 98-202, No.98-203 and No 98-204 approving Reimbursement Agreements with Pulte Home Corporation and William Lyon Homes, Inc, for costs associated with Master Plan Facility Improvements.

 NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the public improvements are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

 BE IT FURTHER RESOLVED that the Performance and Payment Bonds for Trail along the railroad tracks on the east boundary of this subdivision, per Reimbursement Agreement, are hereby accepted.

 BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for the following streets: Thompson Drive, Wassen Court, Tartarian Court, Royal Ann Court, Comice Parkway, Elberta Parkway, Anjou Parkway, Babcock Court, Muscat Court, Carmel Parkway, Sungold Court, Meyers Court and Minnesota Avenue Widening, and all parcels and easements as shown on the Final Map.

 PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 28th day of March 2000 by the following vote:
