Accept On Site Improvements for Maintenance for Subdivision 7873

(Blackhawk –Nunn Partners)

PREVIOUS ACTIONS:

On March 3,1993, by Resolution No. 93-11, the Planning Commission of the City of Brentwood approved the Tentative Map of Subdivision 7816, Brentwood Country Club, with conditions.

On March 23, 1993, the City Council of the City of Brentwood passed Resolution No. 93-151, approving the Final Map for Subdivision 7816, Brentwood Country Club, - Blackhawk-Nunn Partners, with conditions.

On July 22, 1997, the City Council passed Resolution No. 97-161, approving the Final Map of Subdivision 7873, Blackhawk-Nunn Partners, rejecting the offers of dedication shown thereon, accepting the improvement security and approving the Subdivision Improvement Agreement.

RECOMMENDED COUNCIL ACTION:

Passage of a Resolution accepting all on site improvements for maintenance, accepting the Maintenance Bond and releasing the Performance and Payment Bonds for Subdivision 7873, Blackhawk – Nunn Partners.

COMMENTS:

Subdivision Map 7873 is located near the northwest corner of the intersection of Balfour Road and Fairview Avenue and represents one phase of Tentative Map 7816. This phase contains 29 single-family residential lots. A final inspection of the improvements found them to be completed in conformance with the approved improvement plans.

When the Final Map was approved by City Council, the offer of dedication was rejected. Now that the streets are improved, the offers of dedication need to be accepted. Also, acceptance of the improvements requires a 15% maintenance bond for a period of twelve months after acceptance and release of improvement securities, related Performance and Payment Bonds

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE MAINTENANCE BOND AND RELEASING THE RELATED PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISIONS 7873 - BLACKHAWK-NUNN PARTNERS

WHEREAS, on March 3,1993, by Resolution No. 93-11, the Planning Commission approved the Tentative Map of Subdivision 7816, Brentwood Country Club, with conditions; and

WHEREAS, on March 23, 1993, City Council approved the Final Map of Subdivision 7816, Brentwood Country Club - Blackhawk-Nunn Partners, with conditions, by Resolution No. 93-151; and

WHEREAS, On July 22, 1997, City Council passed Resolution No. 97-161, approving the Final Map of Subdivision 7873, Blackhawk-Nunn Partners, rejecting the offers of dedication shown thereon, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the offers of dedication shown on the Final Map were rejected at the time the Final Map was approved; and

WHEREAS, final inspection of the on site improvements found them to be completed in conformance with the approved improvement plans.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements installed within the subdivision are hereby accepted for maintenance purposes, and that the dedications for public use of the private streets and easements shown on the final map are hereby accepted.

BE IT FURTHER RESOLVED that the maintenance bond to guarantee against defects in materials or workmanship for a period of twelve (12) months is hereby accepted, and that the subdivision performance and payment bonds are hereby released.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a copy of this Resolution with the Recorder of Contra Costa County.
