Accepting On Site Improvements for Maintenance for Subdivision 7872,

(Blackhawk–Nunn Partners)

PREVIOUS ACTIONS:

On May 11, 1992, the Planning Commission of the City of Brentwood passed Resolution No. 92-24, approving the Tentative Map for Subdivision 7642, Blackhawk-Nunn Partners, with conditions.

On April 9, 1996, the City Council passed Resolution No. 96-33, approving the Final Map of Subdivision 7872, Blackhawk-Nunn Partners, rejecting the offers of dedication shown thereon, accepting the improvement security and approving the Subdivision Improvement Agreement.

RECOMMENDED COUNCIL ACTION:

Passage of a Resolution accepting on site improvements for maintenance, accepting the Maintenance Bond and releasing the Performance and Payment Bonds for Subdivision 7872, Blackhawk–Nunn Partners.

COMMENTS:

Subdivision Map 7872 is located near the northwest corner of the intersection of Balfour Road and Fairview Avenue and represents the third phase of the 7642 Tentative Map. This phase contains 119 single-family residential lots. A final inspection of the street improvements found them to be completed in conformance with the approved improvement plans.

When the Final Map was approved by City Council, the offers of dedication were rejected. Now that the streets are improved, the offers of dedication need to be accepted. Also, acceptance of the improvements requires 15% maintenance bond for a period of twelve months after acceptance and release of improvement securities and related Performance and Payment Bonds.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE MAINTENANCE BOND AND RELEASING THE RELATED PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 7872, BLACKHAWK-NUNN PARTNERS

WHEREAS, on May 11, 1992, City Council passed Resolution No. 92-24, approving the Tentative Map for Subdivision 7642 with conditions; and

WHEREAS, on April 9, 1996, City Council passed Resolution No. 96-33, approving the Final Map, Subdivision Improvement Agreement, and Improvement Security for Subdivision 7872; and

WHEREAS, the offers of dedication for the streets shown on the Final Map were rejected at the time the Final Map was approved.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the public improvements are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the offers of dedication of Parcels A, B, C, D, E, F, I, J, K and easements as shown on the Final Map 7872, are hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a copy of this Resolution with the Recorder of Contra Costa County.
