REQUEST FOR COUNCIL ACTION
On October 25, 1994, City Council passed Resolution No. 94-178, approving the Final Map of Subdivision 7432, A.D. Seeno Construction Co., accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.
On August 26, 1997, City Council passed Resolution No. 97-190, accepting the offers of dedication of street right of ways, accepting the on site public improvements for maintenance, accepting the Maintenance Bond, and releasing the Performance and Payment Bonds for Subdivision 7432, Edgewood Unit 3 (A.D. Seeno Construction Co.).
RECOMMENDED COUNCIL ACTION:
Passage of a Resolution accepting the improvements for maintenance, accepting the Maintenance Bond, and releasing the associated Performance and Payment Bonds for Summerwood - Edgewood Bridge, CIP Project No. 336-3073, (Albert D. Seeno Construction Co.)
The Final Map is located at the east side of Fairview Avenue and north side of Deer Creek Channel and was recorded on November 3, 1994, in Book 376 of Maps, at page 22, Contra Costa County records. The subdivision contains 96 single-family residential lots. In conjunction with the Final Map, the developer provided Subdivision Performance and Payment Bonds for these on site improvements.
A final inspection of the improvements found them to be completed in conformance with the approved improvement plans. The pedestrian bridge is located in the northeast area of the Subdivision, over Sand Creek. The passage of the resolution for this agenda item is subject to acceptance of all final punch-list items, which already have been approved by City Inspector.
The developer of Subdivision 7432, A.D. Seeno Construction Co., has already provided a Maintenance Bond to cover the twelve-month warranty period for these improvements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY ALBERT D. SEENO CONSTRUCTION CO., FOR THE CONSTRUCTION OF THE SUMMERWOOD - EDGEWOOD BRIDGE, CIP PROJECT NO. 336-3073 (SUBDIVISION 7432), ACCEPTING THE MAINTENANCE BOND, RELEASING THE ASSOCIATED PERFORMANCE AND PAYMENT BONDS, AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER
WHEREAS, On October 25, 1994, the City Council passed Resolution No. 94-178, approving the Final Map of Subdivision 7432, A.D. Seeno Construction Co., accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement, and
WHEREAS, the required public improvements have been completed in conformance with the approved improvement plans.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the public improvements are hereby accepted for maintenance.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material or workmanship for a period of twelve months is hereby accepted.
BE IT FURTHER RESOLVED that the Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.
BE IT FURTHER RESOLVED that the Maintenance Bond is hereby accepted.

NOTICE OF COMPLETION
NOTICE IS HEREBY GIVEN THAT:
THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 10th of September 1997, enter into an agreement with A.D. Seeno Construction Co., for the San Jose Avenue frontage improvements.
The work described in contract documents was to furnish all material, labor, and equipment necessary to complete said project.
The surety on said agreement was held by The American Insurance Company, 777 San Marin Drive, Novato, CA 94998.
On the 14th day of March 2000, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.
I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
