Approval of Contractor Prequalification Package for Various CIP Projects

 

   PREVIOUS ACTIONS:

   RECOMMENDED COUNCIL ACTION:

Pass a Resolution authorizing the City Engineer to implement a prequalification procedure for prospective bidders to construct the City’s Capital Improvement Projects (CIP), and authorizing staff to tailor the contractor prequalification and appeal procedures, prequalification questionnaire and evaluation criteria for each project individually, and release the questionnaire for public response.

COMMENTS:

City engineering staff have been looking for ways to streamline the process in which contractors are chosen to construct the City’s Capital Improvement Projects (CIP).  The current method, which has been the only one available to City’s and most government agencies, was to publicly advertise the project and wait for the lowest bid to be submitted, which then the City was obligated to use unless mitigating circumstances proved otherwise.  Although this system works fairly well, there are times when the City has had less than favorable results from the lowest bidder which usually would equate to delayed projects, change orders and the like.

This past year the California State Legislature enacted a bill which took effect January 1 of this year that expressly authorized local and public entities to prequalify prospective bidders.  This new bill essentially authorizes the City to prepare a prequalification questionnaire, publicly advertise to prospective bidders and then qualify bidders using predetermined criteria such as experience, safety record, resources available, bonding capacity, required contractor’s license, etc.  The contractors that meet the minimum criteria are then allowed to bid on the project and the lowest bid of the prequalified group is selected to do the work.  By utilizing this process, the City should be able to attract the most qualified and competent contractors and should minimize the problems typically associated with having to select the lowest bidder.

This process will not be used on every CIP project due to the time and effort involved in the preparation and review of the prequalification questionnaires.  The biggest benefit will be realized on the major CIP projects, and each project will be evaluated individually to determine if the project would benefit from this procedure.  Attached is a sample Contractor Prequalification Package that will be used as a model for each project.

NOW, THEREFORE, BE IT RESOLVED that the City Engineer is hereby authorized to implement a contractor prequalification procedure for prospective bidders to construct the City’s Capital Improvement Projects (CIP).  

BE IT FURTHER RESOLVED that staff is hereby authorized to tailor the contractor prequalification and appeal procedures, prequalification questionnaire and evaluation criteria for each project individually, and release the questionnaire for public responses
