Accept in tract improvements for Subdivision 8011-Townsquare Unit #3 (Greystone Homes)

 

   PREVIOUS ACTIONS:

  On March 24, 1998, the City Council passed Resolution No. 98-01, approving the Final Map of Subdivision 8011,Greystone Homes, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.

   RECOMMENDED COUNCIL ACTION:

  Passage of a Resolution accepting the improvements for maintenance, accepting the Subdivision Maintenance Bond, and releasing the associated Subdivision Performance and Payment Bonds for Subdivision 8011, Townsquare Unit #3, Greystone Homes.

   COMMENTS:

  The Final Map is located at the northwest corner of Fairview Avenue and San Jose Avenue, and was recorded on May 19, 1998, in Book 400 of Maps, at page 11, Contra Costa County records.  The subdivision contains 75 single-family residential lots.  In conjunction with the Final Map, the developer provided Subdivision Performance and Payment Bonds for these in-tract improvements.  A final inspection of the improvements found them to be completed in conformance with the approved improvement plans.

  The passage of the resolution for this agenda item is subject to receipt of a check in the amount of $30,000 per attached letter of agreement from Greystone Homes confirming their agreement to complete the Landscaping Improvements on streets: Alder Creek Way, Shadowcliff Way, Vale Court and Highland Drive in Subdivision 7995 as agreed upon in the meeting between the City of Brentwood and Greystone Homes on December 20, 1999.

  The developer of Subdivision 8011, Greystone Homes, has already provided Subdivision Maintenance Bond to cover the twelve-month warranty period for these improvements.  A Lighting and Landscape Maintenance District has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.       

  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE SUBDIVISION IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE MAINTENANCE BOND, AND RELEASING THE ASSOCIATED PERFORMANCE AND PAYMENT BONDS FOR ALL IN TRACT IMPROVEMENTS FOR SUBDIVISION 8011, TOWNSQUARE Unit #3, GREYSTONE HOMES 

            WHEREAS, on March 24, 1998, the City Council passed Resolution No. 98-01, approving the Final Map of Subdivision 8011, Greystone Homes, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

            WHEREAS, the required public improvements have been completed in conformance with the approved improvement plans.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the subdivision improvements are hereby accepted for maintenance.

            BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material or workmanship for a period of twelve months is hereby accepted.

            BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

            BE IT FURTHER RESOLVED that the Subdivision Maintenance Bond is hereby accepted.
