Accept off-site improvements on Fairview Avenue Subdivision 8011 (portion of Tentative Map7948) (Greystone Homes)

PREVIOUS ACTIONS:

  On August 19,1997, the Planning Commission passed Resolution No. 95-12, approving the conditions of approval for Amended Tentative Subdivision Map No. 7948-A, and conditioned Fairview Avenue to be improved.

On February 8, 2000, the City Council passed Resolution No. 2006, accepting the Offers of Dedications of streets right of way, the public improvements for maintenance, Maintenance bond and releasing the associated Performance and Payment Bond for Subdivision 7948.

RECOMMENDED COUNCIL ACTION:

Passage of a Resolution accepting the off-site improvements on Fairview Avenue for maintenance, accepting the Maintenance Bond, and releasing the associated Performance and Payment Bonds for Subdivision 8011 (portion of Tentative Map 7948), Greystone Homes.

COMMENTS:

The Final Map 8011 is located at the northwest corner of Fairview Avenue and San Jose Avenue, and was recorded on May 19, 1998, in Book 400 of Maps, at page 11, Contra Costa County records.  The subdivision contains 75 single-family residential lots.  In conjunction with the Final Map, the developer provided off-site Performance and Payment Bonds for these Fairview Avenue improvements.  A final inspection of the off-site improvements found them to be completed in conformance with the approved improvement plans.

  The passage of the resolution for this agenda item is subject to receipt of a check in the amount of $30,000 per attached letter of agreement from Greystone Homes confirming their agreement to complete the Landscaping Improvements on streets: Alder Creek Way, Shadowcliff Way, Vale Court and Highland Drive in Subdivision 7995 as agreed upon in the meeting between the City of Brentwood and Greystone Homes on December 20, 1999.

The developer of Subdivision 8011 (Portion of Tentative Map 7948), Greystone Homes, has already provided a Maintenance Bond to cover the twelve-month warranty period for these improvements.  A Lighting and Landscape Maintenance District has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.       

 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFF-SITE IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE MAINTENANCE BOND, AND RELEASING THE ASSOCIATED PERFORMANCE AND PAYMENT BONDS FOR PUBLIC IMPROVEMENTS ALONG FAIRVIEW AVENUE IN SUBDIVISION 8011 (PORTION OF TENTATIVE MAP 7948) GREYSTONE HOMES

            WHEREAS, on August 19, 1997, the Planning Commission passed Resolution No. 95-12, approving the Amended Conditions for Tentative Subdivision 7948-A, Greystone Homes; and

WHEREAS, on February 8, 2000, the City Council of the City of Brentwood passed Resolution No. 2006, accepting the Offers of Dedications of streets right of way, accepting the public improvements for maintenance, accepting the Maintenance Bond, and releasing the associated Performance and Payment Bonds for Subdivision 7948; and

            WHEREAS, the required public improvements have been completed in conformance with the approved improvement plans and approve amended conditions of approval.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the public improvements are hereby accepted for maintenance.

            BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material or workmanship for a period of twelve months is hereby accepted.

            BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

            BE IT FURTHER RESOLVED that the Subdivision Maintenance Bond is hereby accepted.
