On April 12, 1994, Council passed Resolution No. 94-63, which established a standard Reimbursement Agreement for Master Plan Facilities Improvements.
RECOMMENDED COUNCIL ACTION:
Pass a Resolution approving Reimbursement Agreement with Ryder Homes for costs associated with Master Plan Facility Improvements.
On February 20, 1996, the Planning Commission of the City of Brentwood approved Tentative Map 7844. Conditions of approval for this map required the developer to make certain Master Plan Facility Improvements. Master Plan Facility Improvements are those improvements that have been identified in the Master Infrastructure element of the General Plan. These facilities are considered backbone infrastructure and form the basis of the facility fee structure. Under most circumstances when these improvements are required to be constructed by a developer, they would provide capacity in excess of the needs of their development alone. The Subdivision Map Act requires that the City enter into a reimbursement agreement when requiring the developer to construct improvements with excess capacity. The reimbursement calculations are based on the City of Brentwood 1999 Development Fee Program. The improvements, which qualify as excess capacity, are oversize and off-site roadway improvements along Balfour Road, pre-payment of fees for roadway facilities, pre-payment of fees for water facilities and pre-payment of fees for the wastewater treatment plant expansion.

RESOLUTION NO. 99-_____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A REIMBURSEMENT AGREEMENT WITH RYDER HOMES SUBDIVISION 7844, FOR COSTS ASSOCIATED WITH MASTER PLAN FACILITY IMPROVEMENTS.
WHEREAS, in February 1996, the Planning Commission of the City of Brentwood, adopted Resolution No. 96-04 which required the Developers of Tentative Subdivision No. 7844, to make certain Master Plan Facility Improvements; and
WHEREAS, certain Master Plan Facility improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and
WHEREAS, the Developer will make improvements eligible for reimbursement.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood approves a Reimbursement Agreement with Ryder Homes for Master Plan Improvements to be constructed in conjunction with Subdivision 7844, covered under Tentative Subdivision Map No. 7844 as shown on attached Exhibit A.
