CITY OF BRENTWOOD
SPECIAL CITY COUNCIL MEETING
July 8, 2004
A special meeting of the City Council of the City of Brentwood was called to
order at 3:05 p.m. in the City Council Chambers located at 734 Third Street,
Brentwood, California, with Vice Mayor Beckstrand presiding.
Present: Council Members Beckstrand, Gutierrez, Petrovich
Absent: Council Member Hill, Mayor Swisher
1. Confirming the direction of the City Manager to exclude the community
college site from the annexation request relating to the Vineyards at Marsh
Creek. (J. Stevenson)
City Manager, John Stevenson, presented a staff report, noting that it was
the City’s intent to make sure that the site was for a community college. He
added that the City had been working closely with the Community College
District and that the site could be removed from the current request and
return when the community college was ready to start construction. The City
had requested that the 30 acres be removed from the application and Manager
Stevenson asked for concurrence from the Council.
Council Member Gutierrez asked if an agreement could be prepared with Contra
Costa Community College designating the area as a college site and if the
site did not get built by the sunset date in 2012, the City would then give
it back.
City Attorney, Dennis Beougher, said that once the site was in the City’s
jurisdiction, a future City Council could decide that it did not want to go
along and the site could be de-annexed. Public land was not subject to
Measure C and notwithstanding the urban limit line, at any time they could
request that the site be annexed and still meet the LAFCO/Measure C
requirements.
The Council expressed concerns that by removing the 30 acre college campus
site from the annexation request, the public might feel it implied the City
was removing its support for the campus.
It was moved/seconded by Beckstrand/Petrovich to confirm the direction of
the City Manager to exclude the community college site from the annexation
request relating to the Vineyards at Marsh Creek. Motion carried. Council
Member Hill and Mayor Swisher absent.
ADJOURNMENT
It was moved/seconded by Petrovich/Beckstrand to adjourn the special
meeting. Motion carried. Council Member Hill and Mayor Swisher absent.
There being no further business the special meeting was adjourned at 3:30
p.m.
