CITY OF BRENTWOOD
SPECIAL CITY COUNCIL MEETING
Minutes of April 18, 2002

A special meeting of the City Council of the City of Brentwood was called to order at 3:40 p.m. in the City Council Chambers located at 734 Third Street, with Mayor McPoland presiding.

ROLL CALL
Present: Councilmembers Beckstrand, Hill, Petrovich, Mayor McPoland 
Absent: Councilmember Gomes

CITIZEN COMMENTS 

Chris Mosser, 304 Mondavi Lane, Brentwood, advised that he was resigning from the Planning Commission and read his letter of resignation into the record.

The Council personally thanked Mr. Mosser for all his hard work on the Planning Commission citing that he has been instrumental in the development of the City and that he will be missed.

PUBLIC HEARING

4. Approve a Resolution Declaring State Route 4 Bypass a Private Road Open for Public Use.

Councilmember Beckstrand commented that she had asked the City Attorney to be sure that in doing this, we are not assuming any liability other than that of the behavior of our Police Officers as they patrol and enforce codes on this private road. She further stated that she is not interested in anything that would open our liability in any other way with regards to this roadway. 

Dennis Beougher, City Attorney, explained that the Highway 4 Bypass has asked the City to enter into a maintenance agreement to maintain that section of road. He further stated that there are some negotiations going on. If we do agree to do that, we will incur additional liability but that would be a separate agreement and is in no way related to this item.

The public hearing was opened.

There being no one wishing to speak, the hear was closed.

RESOLUTION NO. 2515
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD FINDING AND DECLARING STATE ROUTE 4 BYPASS SEGMENT BETWEEN LONE TREE WAY AND BALFOUR ROAD A PRIVATE ROAD OPEN TO THE PUBLIC

It was moved/seconded by Petrovich/Hill to approve Resolution No. 2515 Declaring State Route 4 Bypass a Private Road Open for Public Use. Motion carried by the following vote:

AYES: Councilmembers Beckstrand, Hill, Petrovich, Mayor McPoland
NOES: None
ABSENT: Councilmember Gomes
ABSTAIN: None

ADJOURNMENT

There being not further business, the meeting was adjourned at 3:50 p.m.
