A special meeting of the City Council of the City of Brentwood was called to order at 4:00 p.m. in the City Council Chambers located at 734 Third Street, Brentwood, California, with Mayor McPoland presiding.

Notice of proposed modification to MOU concerning water transmission facilities-Contra Costa Water District.
Contra Costa Water District submitted a letter opposing this item.
Dennis Beougher, City Attorney, stated that there is a previous MOU between the City and the water district and AIG Baker has asked the City to waive the rights it may have to that area. He stated that Diablo Water District is making this an issue with AIG Baker and the parking lot that is proposed on the western border of the development. In the condemnation order the original owner reserved the right to put a public street over this same property and only reserve the right to not have the current owner interfere with its use as a water line. He stated that this action would just direct staff to send a notice of intent to negotiate a reconsideration on the one portion of the trail and that this needs to be done ninety-days before the end of the term.
Mayor McPoland stated he read a portion of the MOU and it clearly states that it would allow the paving of a street, and asked if a parking lot would be considered the same. Mr. Beougher stated he would consider it the same.
It was moved/seconded by Petrovich/Hill to direct staff to send the notice of proposed modification to the MOU concerning water transmission facilities with Contra Costa Water District. Motion carried with Councilmember Gomes being absent.
There being no further business the meeting was adjourned at 4:10 p.m.
